Firstly, Winstanley Hall has no descendants. This is due to the fact that it's a building and does not reproduce.

Secondly, the Winstanley estate (owned by Bankes) stopped at Smithy Brook, where the Hindley estate started.
So, it follows that the land the churchyard is on used to belong to the Winstanley estate, although it probably doesn't now.

I would say it belonged to the church.
