Notice, although it's actually Cllr. Steve Jones who is the plaintiff in this case, it's always 'we' did this, 'we' said that and 'we' told whoever, whatever.

They, obviously, refer to the 'independent group' of councillors, but, in law, it's only Cllr. Steve Jones who is involved.

Gareth Fairhurst has 'won' nothing. In reality, neither has Cllr. Steve Jones, apart from progressing one stage further in his quest to over-rule tha council.
He hasn't had the Judicial Review yet, just been granted one. What the outcome of the Judicial Review might be, remains to be seen and that's what counts.

There'll only be a 'winner' when the fat lady sings!

I am no legal eagle but it looks like Wigan Council have yet to play their trump card!

You need to hope Fairhurst and co have kept something up their sleeve Hossy but knowing how he can't play the long game and likes to use that mouth of his and try to twist every situation in his favour........I doubt it.

To be honest I can't see what all the fuss is about, if Bryn want the wife beating and drink driving Steve Jones to be their councilor they will vote him in, simple as that. Its a process known as democracy, the very same process that Donna Hall is preserving for the public interest and the same one that led to Fairhurst losing in Standish. Of course if Jones looses there may well be one less independent on the council and one less in the Fairhurst fan club but........and let's he honest here, THAT is what all this is really about!

Considering their duty is to act in the best interest of the electorate I am still a bit unclear on what it is the council actually did wrong though. Maybe you could explain to us all Hoss....in simple term?

The council called an unlawful election based on a potential resignation that was rescinded. The returning officer who happens to be CEO should be held at least partially responsible. Both parties are partly to blame for it getting to this situation though

The judge saw it for what it was - a vicious vendetta against anyone (in this case Cllr Jones) who dares to cross them.
It was clear to me from the very start that the clowncil's position was untenable. Cllr Jones's initial letter was clear - It is my INTENTION to resign - that's not a resignation and can clearly be rescinded after reflection.
Why Donna's jumped the gun and called an election so quickly is anybody's guess but logic says it was done to wipe another independent dissenter from the democratic role.
There's a lot of shit in those Wigan Today articles today and yesterday from both the council and that prospective candidate for Bryn (a new Ash stooge ? which woodwork did she pop up out of ?) about 'the democratic rights of Bryners being pulled from under them' and that sort of crap. Bollocks that is.
The 'returning (unfortunately again and again) occifer' should be made to pay every single penny of the costs of this farce from her tidy little salary. Oh but she's representing the council isn't she so it's the taxpayer who gets shafted for it. How many 10's (or evne 100's ?) of thousands more does she now have to save to pay for her flying-off-the-handle antics ?

Stardelta has I see revealed undeniably and unequivocably this time his true council cuddling colours in trying to defend the council's position in the face of undeniable evidence and a judges common sense assessment.

Now I'm a true Labour man (not a new labour muppet - aka liberals)... I'm a socialist, yes we still exist, are proud to be and are more than capable of whipping the cream off the tory tart at the next election.

As for Mr Fairhurst, I don't know the man, but credit where credit is due for more than just supporting a fellow 'party' member but backing him to the hilt. Unpopular in some quarters he may be but I challenge anyone to seriously counter anything he writes on his blog.

I'm tempted to go into the top-hatted prat's role in this affair but it's friday and I don't want to spoil the start of my wekeend thinking about a burk's peerage.

Congratulations Cllr Jones (& Co), and long may you remain a councillor. Democracy demands it !

Yep.....in the eyes of the judge she got it wrong, but given the situation has never arisen before what can you expect. Furthermore we will NEVER kniw the true interntions or motivations of those involved. As for this petition? Given the 38 degs TOS I don't think it will last long Hoss.


2.1.2 We reserve the right to edit or remove petitions targeting individuals when we believe they:
Infringe upon their human rights or employment rights
For example by calling for an employee in a non-elected job to be sacked
Infringe on their right to a fair trial
Are quite simply nasty

But as we all know and have seen, morality and indeed rules are both alien concepts as far as Fairhurst is concerned.


I did say in a previous post Hoss that many, including myself believe Fairhurst has some 'issues upstairs' if you know what I mean and this is just another example of both his obsesion and his refusal to come to terms with his past failures.

I also believe more and more people are now coming to the conclusion that his conduct, the torrents of abuse and the endless harrasment he directs to council authority figures and his rivals are indicative of nothing but a deep insecurity and form part of a personal vendetta, as such, not to be taken seriously.

I really do think its a crying shame that he has to behave in this way and that he can't channel the efforts into something positive....... like being a successful and respected councillor!!

The judge made a costs order in favour of Steve Jones. Cost orders are normally only awarded in full when the judge believes the party involved to be free from blame. Otherwise the costs order value is reduced in line with the judge’s assessment of the degree of culpability of the party concerned.

Whilst I am glad that justice has prevailed I would like to say congratulations to MR GARETH FAIRHURST. After 983 shots at Ms Halls goal he has finally managed to get a shot on target. I would think his previous 982 shots have incurred quite a lot of expense to sort out but who is bothered about that money. I bet there has been weekend long celebrations in the most famous of political households.

I don't need to ask the judge. He may have found in Steve Jones favour but Donna Hall did not instigate this debacle, that is a fact.

Why would SD need to recruit people? Any normal, right thinking person can see this for what it is.

Black's Law Dictionary defines unlawful as not authorized by law, illegal. Illegal is defined as forbidden by law, unlawful. Semantically, there is a slight difference.

Hi Spiderwoman, Steve Jones did not send a resignation letter, if he had the council would not have lost the case. The judge called the by-election "unlawful".

I do blame Donna Hall and the council for this. As returning officer she should have known she didn't have sufficient grounds to call a by-election. Even if she didn't know at first, by the time it was clear it was going to court someone at the council should have realised it was a lost cause and not wasted our money trying to defend it. If a labour councilor had said they wanted to quit I think the council would have acted differently.

Jones submitted a letter saying he was resigning on a specific date. The council then arranged a by-election to be held the day after. Jones then said he was rescinding his resignation. The council said fair enough but you will have to stand in the by-election and if you are relected you can have the position back because this is the fair and democratic way. Jones said no and I don't care how much its cost so far, how many others have been messed around or if its fair and democratic.

This situation had never arisen before and it took a judge to decide what should be done.

Donna Hall didn't break any laws at the time for the simple reason there weren't any that applied at the time she made the decision.

This is why a judge had to make the call. Key fact, and one that is being overlooked, it was a hearing not a trial and as such there was no prosecution involved, no verdicts, no convictions, no sentences.

The decision has NOW been judged illegal but because it wasn't at the time.......there is no guilt.

The decision by the judge will now have set a precedent.

Of course the media and Fairhurst won't tell you all that.

I don't know a great deal about the law and legal proceedings Leccy.....but it seems I know more than you

Of course the other thing to consider Leccy....if it could be proven that Donna Hall knowingly and willingly broke laws at the time she made the call, Fairhurst and his crew would have called for a prosecution.

They didn't.......can you think of any reason why they didn't Leccy?

The letter that Steve Jones sent to Wigan Council is on Twitter. It looks like it was sent via Facebook and it's title is "Resignation". It is dated 5th January. He goes on to say that as of February 20th he would no longer be Councillor for Bryn, citing recent events and personal problems, feels he can no longer represent the community etc.

Read it and make your own mind up.

Yes they did loose Leccy, and I was disgusted at the verdict.

Not because as some believe I think Wigan council can do no wrong but because the law of this land has in effect stuck two fingers up against the values of honesty, personal responsibility and integrity, and most importantly democracy.

Its a travesty, and furthermore I believe the reason the council are not taking it further is because they don't have to. It seems they are quite happy to let people form their own opinions, both of the situation. And of the persons who instigated this fiasco.

Couldn't have put it better myself, SD.

I would also like to add that the standing of these people was further diminished the minute Fairhurst arranged an online petition calling for Donna Hall to be sacked.

It takes a particular kind of character to actively seek to deprive someone of their job, income and livelihood. If anyone thinks this is ok, I would ask, how would you feel if this was done to you?

Err......they got a letter of resignation from Jones and it was confirmed verbally in a meeting, he also informed his constituents via social media. He then backtraked and rescinded his notice. The council refused to accept as they believed it was both unfair and undemocratic. The issue centered on if councillors are subject to the same laws as employees, not if letters were/were not sent or received.

It begs the question if they are, why can't they be sacked for misconduct like employees can. The verdict sets a very interesting precedent.

I really am struggling to understand why people seem incapable of understanding exactly what went on.

I agree with what Lord Smith said about Jones being unfit for office based on the drink driving and assault. I think these convictions should have also been taken into account in the high court.

Councillors are public figures and as such should be role models for other citizens.
The people of Bryn should have been allowed to decide whether they still wanted Jones at the by-election. Instead they had that right taken away by a judge. That is not democracy.

Steve Jones did not send a proper letter of resignation to the council. That was the entire basis of his argument and two top judges agreed with him.

Mr Justice Kerr said: “On the question of whether the claimant resigned by written notice, if I had to decide today I would decide without much difficulty he did not."

Mr Justice Martin Spencer found returning officer Donna Hall had no jurisdiction to start the process of choosing a new ward representative to replace Steve Jones. He said this was a very rare occasion where the courts intervening in local democracy was justified. This was because the vote in Bryn was simply “not lawful”, the judge said.


The fact is the council acted unlawfully. I think they jumped the gun because they wanted rid of Steve Jones. Peter Smiths comments suggest I am right.
