Steve Jones did not send a proper letter of resignation to the council. That was the entire basis of his argument and two top judges agreed with him.
Mr Justice Kerr said: “On the question of whether the claimant resigned by written notice, if I had to decide today I would decide without much difficulty he did not."
Mr Justice Martin Spencer found returning officer Donna Hall had no jurisdiction to start the process of choosing a new ward representative to replace Steve Jones. He said this was a very rare occasion where the courts intervening in local democracy was justified. This was because the vote in Bryn was simply “not lawful”, the judge said.
The fact is the council acted unlawfully. I think they jumped the gun because they wanted rid of Steve Jones. Peter Smiths comments suggest I am right.
